These Terms of Service (“Terms”) describe your rights and responsibilities when accessing or using the Services. By visiting PotentGarden.com, creating an account, submitting an order, or otherwise using the Services, you agree to these Terms and the policies incorporated into them, including our Privacy Policy, Returns & Refunds Policy, Shipping Policy, and Subscription Policy.
If you do not agree to these Terms, please do not use the Services.
1. Eligibility and Customer Accounts
You must be at least the age of majority in your state of residence to make a purchase through the Services. If you permit a minor to use the Services through a device or account you own or control, you are responsible for that use.
You agree to provide accurate, current, and complete information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
You may not transfer, sell, or assign your customer account to another person.
2. Product Information
We make reasonable efforts to present accurate product descriptions, images, ingredient information, quantities, prices, and availability. Product packaging, labeling, colors, or appearance may differ slightly from images displayed on your device or from earlier versions of the product.
Product descriptions, formulas, packaging, prices, and availability may be updated without notice. We reserve the right to discontinue products or limit quantities offered to any person, household, geographic area, or jurisdiction.

3. Dietary Supplement and Wellness Information

4. Orders and Acceptance
Submitting an order constitutes an offer to purchase. Receipt of an automated order acknowledgment does not necessarily mean that we have accepted or agreed to fulfill the order.
Orders may be subject to payment authorization, fraud screening, inventory verification, address verification, and other reasonable review. We reserve the right to accept, decline, place on hold, limit, or cancel an order before fulfillment, including orders that appear fraudulent, unauthorized, inaccurate, duplicated, or intended for unauthorized resale.
If we decline, modify, or cancel an order after payment has been captured, we will issue any applicable refund to the original payment method. We may contact you using the email address, telephone number, billing address, or shipping information supplied with the order.
Purchases made through PotentGarden.com are intended for personal or household use unless we agree otherwise in writing.
5. Prices, Promotions, and Payment
Prices, discounts, promotions, and product availability may change without notice. The amount charged will be the amount displayed at checkout when the order is submitted, subject to correction of errors.
Applicable taxes and any shipping charges will be displayed during checkout. Promotional offers may be governed by additional terms. If promotion-specific terms conflict with these Terms, the promotion-specific terms will control for that promotion.
You represent that you are authorized to use the payment method submitted with your order and that the payment and billing information you provide is accurate.
We may correct pricing, promotional, or product-information errors and may cancel an affected order when permitted by law. If payment has already been captured for a canceled order, the applicable amount will be refunded to the original payment method.
6. Shipping and Third-Party Fulfillment
Shipping availability, estimated delivery times, and any applicable free-shipping offer are described on our website or during checkout. Delivery dates are estimates and are not guaranteed.
Orders placed through PotentGarden.com may be packed and shipped by Amazon or another third-party fulfillment provider. An order may therefore arrive in Amazon-branded or other third-party packaging, and its tracking information may identify the fulfillment provider or carrier.
Even when an order is fulfilled by Amazon, purchases made through PotentGarden.com remain Potent Garden website orders. Questions, refund requests, or order concerns must be directed to Potent Garden rather than Amazon customer service.
We are not responsible for delays caused by carriers, weather, natural disasters, incorrect or incomplete addresses, government actions, or other circumstances outside our reasonable control. Please contact us promptly if tracking shows a delivery problem so we can review the available information.

7. Returns, Refunds, and Order Cancellations
Purchases are subject to our Returns & Refunds Policy, which explains our 30-day satisfaction guarantee, eligibility requirements, damaged or incorrect products, refund processing, and order-cancellation procedures.
Because dietary supplements are consumable products, Potent Garden generally does not accept or require physical product returns. This does not limit any rights available under applicable law.
Purchases made directly through Amazon.com or another retailer are transactions with that seller and must be handled according to the seller’s policies.
8. Subscriptions
Subscription availability, discounts, delivery frequency, billing arrangements, and other applicable terms will be presented when you enroll.
Depending on the subscription arrangement, you may receive an invoice or payment request before a scheduled order is processed. An unpaid invoice or unsuccessful payment may prevent that order from being processed or shipped.
Skipping, pausing, rescheduling, or canceling a subscription affects only future scheduled orders. It does not automatically cancel or refund an order that has already been paid, processed, or shipped.
Please make subscription changes before the next scheduled invoice or order is generated. Additional terms are provided in our Subscription Policy and in the subscription information presented during enrollment.
9. Privacy
Our collection and use of personal information are governed by our Privacy Policy.
Because the Services are powered by Shopify, Shopify may collect and process certain information relating to your access to and use of the Services. Information may also be shared with service providers that assist with payments, fraud prevention, subscriptions, fulfillment, shipping, analytics, communications, and website operation, as described in our Privacy Policy.
10. Relationship With Shopify
Shopify provides the e-commerce technology that enables us to offer the Services. Purchases made through PotentGarden.com are made directly from Potent Garden—not Shopify.
Shopify is not the seller of Potent Garden products and is not responsible for product fulfillment, product quality, customer-service decisions, refunds, or other aspects of transactions between Potent Garden and its customers, except for services Shopify separately provides under its own terms and policies.
11. Intellectual Property
The Services and their content—including Potent Garden names, logos, product names, product images, label designs, text, graphics, videos, photographs, website design, and other materials—are owned by or licensed to Potent Garden and are protected by applicable intellectual-property laws.
You may access the Services for personal, noncommercial use. You may not reproduce, distribute, modify, republish, sell, exploit, or create derivative works from our content without prior written permission, except as allowed by law.
Nothing in these Terms grants you ownership of or a license to use Potent Garden trademarks, branding, or other intellectual property except for the limited personal use of the Services described above.
12. Feedback, Reviews, and Submissions
If you submit a review, suggestion, photograph, comment, idea, or other content to us (“Feedback”), you represent that you have the right to provide it and that it is accurate and does not violate another person’s rights.
Unless we agree otherwise, you grant Potent Garden a nonexclusive, worldwide, royalty-free license to use, reproduce, modify, display, and distribute Feedback for purposes related to operating, improving, and promoting our business and Services.
We may remove or decline to publish Feedback that is unlawful, deceptive, abusive, defamatory, infringing, unrelated, or otherwise inappropriate. We are not obligated to maintain Feedback in confidence, compensate you for it, publish it, or respond to it.
13. Third-Party Services and Links
The Services may contain links to or integrations with third-party websites, applications, payment services, subscription providers, fulfillment providers, carriers, or other tools.
We do not control third-party services and are not responsible for their independent content, availability, security, policies, or practices. Your use of a third-party service may be governed by that provider’s own terms and privacy policy.
A link or integration does not necessarily constitute an endorsement of the third party.
14. Prohibited Uses
You may not use the Services:

We do not guarantee that the website will always be uninterrupted, secure, timely, or error-free. We do not make warranties regarding third-party services, internet availability, carriers, or circumstances outside our reasonable control.
Nothing in this section excludes any warranty or consumer right that cannot lawfully be excluded.
16. Limitation of Liability
To the fullest extent permitted by law, Potent Garden and its owners, officers, employees, affiliates, agents, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost revenue, lost savings, or loss of data, arising from or related to the Services.
Where liability cannot be excluded, our liability will be limited to the maximum extent permitted by applicable law.
Nothing in these Terms limits liability or consumer rights that cannot legally be limited or waived.

To the extent permitted by law, you agree to indemnify and hold Potent Garden and its owners, officers, employees, affiliates, agents, contractors, and service providers harmless from third-party claims, losses, or reasonable costs arising from your unlawful use of the Services, your material breach of these Terms, or your violation of another person’s rights.
18. Suspension and Termination
We may suspend or terminate your access to all or part of the Services if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive activity, or created a security or legal risk.
Termination does not affect obligations or liabilities that arose before termination. Provisions that by their nature should survive termination—including intellectual-property, liability, indemnification, and governing-law provisions—will remain effective.
19. Severability and Waiver
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in effect.
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
20. Entire Agreement and Assignment
These Terms and the policies incorporated into them constitute the agreement between you and Potent Garden concerning your use of the Services and supersede prior communications concerning that subject.
You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, or other lawful business transfer.
21. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable consumer-protection laws require otherwise.
To the extent a dispute may lawfully be required to proceed in a particular forum, the parties consent to the jurisdiction of the appropriate state or federal courts serving Broward County, Florida.
Nothing in this section limits any non-waivable rights available under applicable law.
